This thesis deal with thc problem of the supervision and the control in the interaational transport and the author treats them as the integral whole in contrast to the past usually partial approaches in the technical literature. The different aspects of the control-supervisory action in various forms of the intemational transport are covered by studies and the author thoroughly deals with the survey of th standards or the direct and indirect control of all the participants in the interaational transport and especially goverament offices, inspection services and the other authorities. It is especially pointed to the comp!ex importance of the control-supervisory action for the participants in the intemational transport, as for the ordering party in some modes of transport, so for the carrier and goverament offices.
Proceeding from a viewpoint that for the complex realization of these problems the interdisciplinary approach is necessary (from the aspect of law, commerce economy, technical etc.) this thesis is divided into seven chapters of which the first Chapter gives the comparative survey of the control and supervisory standards in the high developed countries while the Seven Chapter gives their concretisation on example on the example of our largest port - Luka Bar.
The First Chapter is concemed with the examination of the control as the collection of standards of the direct supervision in the intemational transport of goods, means of transport, passengers and their luggage. It deals with their detailed account of the standards of customs control in relation to the goods which is the subject of the intemational transport such as keeping and custom inspection, the carriage of dutiable goods through our custom territory, putting the custom marks. Their common cbaracteristic is prevention of the unauthorized treatment of goods, which is liable to control and the insurance its identity in order to avoid the possible manipulation and misuses. The goods is not only the subject to control of the authorized organs, because the means of transport, passengers, and luggage are liable to control as well. That is why this chapter describes in details the measures of inspection and search of the means of transport, drives and crew as well as measures of inspection and search of the passenger and their luggage including the personal search of the passengers as the exceptional measures only as case of doubt.
In the Second Chapter the author has described the contemporary supervisory action in the intemational transport in its different forms through the synthesis of the theory of law, legal regulations and the ruling practice. In addition to the custom supervision which is one of the most important and covering collection of the supervisory standards, the other forms are discussed phytosanitary and veterinary supervision, sanitary supervision of the imported victuals and things for the general use as well as the supervisory for the intemal security forces, border bodies and inspection services of the govemment office. All these forms of the supervisory action are treated as the subsystem of the unique system of the supervision in the intemational transport and each of them in its sphere of authority of the involved organs contributes to the undisturbed development of the intemational transport and commerce as well as the state security, where this transport and commerce develop.
The Third Chapter deals with the standards and procedures of the supervisory action in the relevant branches of the contemporary intemational transport: railway, road-haulage, water, air and combined then the transport which develops troughs pipes and pipelines, postal service and telecommunications.
In the fourth part it is discussed the action of control and supervision function according store of merchandise its loađing and underloading in intemational transport, the ways of storing merchandise the same as control and supervision at the moment of loading and unloading merchandise with special review on maritime transport.
In the fifth part it is discussed the function and organization of informative system in the change of control and supervision in all ways of transport. Application of contemporary informative technologies found its use at first in existence of contemporary informative system which include automatization in action of transport. However it found its use in automatisation of making and course of document which follows the transport. It is all possible thanks to use of contemporary computer and communication system as well as to application of methods and techniques of modemize of previous mentioned system.
In the Sixth Chapter the author completes the previous examination with the comparative analyses of the legislative legal regulations of control-supervisory action in the high developed countries and countries in the development. In this analysis’s special attention is paid both to the comparative legal examination of the customs tariff in the national customs laws of the leading countries of Europe and world and to the comparative examination of prohibition of the postal parcels in the intemational transport between these countries. This comparative examination enables the reader to acquire to complete insight into these problem and to assume a critical attitude based on the similarities ad differences of the legislation of some countries. Finality, it is given a special reference to the influence which have new intemational standards for the system of the quality ISO 9000 on the procedure of the clearance and custom control in the contemporary intemational transport.
In the Seven Chapter is considered with standards of the control and supervision in our largest seaport - Luka Bar. Luka Bar is chosen not only because it has role for our country ffom the transport economic aspect but owing to the fact it represent an appropriate example to illustrate different aspects of the control and supervisory action in the intemational transport, as Luka Bar unites technological facilities of the port terminal for combined transport with the economic capacities of the free zone. The wider analysis shows all potential which Luka Bar possesses ffom aspect of the perspective for its long term development, especially if we take into account the new law of Montenegro of companies and development of the intemational business transactions.
This thematic and methodological approach to the problem of the control and supervision treated integrally and interdisciplinary, is the main contribution of this thesis because it enables the reader to have the complete insight into this matter, sublimating the knowledge and experience which have been acquired only consulting a great of scientific and technical publication which have approached this matter partially or within the scope of some wider problems.
